Monsanto Roundup Class-Action Lawsuit

Currently, the Monsanto class action lawsuits are composed of individuals that are victims of exposure to glyphosate; the majority of them are agricultural workers, garden center workers, nursery employees, and landscapers. However, many Roundup victims were simply exposed at home or lived on the edges of farms. Glyphosate can be absorbed through the skin, and higher doses of it may result in a higher likelihood of cancer.

On February 27, 2017, Judge Vince Chhabria of San Francisco’s Norther District of California ordered Monsanto to release a bulk of communications and other records, despite numerous filings by Monsanto designed to block their release. Judge Chhabria explained: “I have a problem with Monsanto, because it’s – it is insisting that stuff be filed under seal that should not be filed under seal.” When documents are “relevant to the litigation, they shouldn’t be under seal” even if they are “embarrassing to Monsanto.” The plaintiffs hope the materials they received as a result of that order will contain the information required to hold Monsanto accountable. It may have already started: in a separate case, the State of California has already ordered Monsanto to begin placing warnings about glyphosate’s carcinogenetic nature on their Roundup© products.

Why the class-action against Monsanto?

The lawsuit alleges that Monsanto published phony research on glyphosate in order to obscure any connection between cancer and glyphosate. The suits allege that their motive in doing so was to protect glyphosate from any inference of cancer because that would hurt Monsanto’s profit margin. At this point it is unclear when Monsanto learned of the potential association of their product and increased risk of cancer.
